Terms of Service
The terms below apply to every drone cinematography and photography service Olivier Hurk Aerial delivers, unless we agree otherwise in a signed quote.

1. Parties
These terms apply between Olivier van den Hurk, trading as Olivier Hurk Aerial, based in the Netherlands (the “Provider”), and the natural or legal person who commissions a service (the “Client”).
2. Quote and acceptance
Each project starts with a written quote describing scope, location, deliverables, timeline and price. A project is confirmed once the Client accepts the quote in writing (email is sufficient) and any agreed deposit is received.
3. Pricing and payment
- Prices are in euros (EUR), exclusive of 21% Dutch VAT unless the Client provides a valid EU VAT number for reverse charge.
- For new clients we may request a 30% deposit before the shoot. The remaining balance is due within 14 days of delivery.
- Travel, accommodation, location permits and additional crew are billed at cost unless included in the quote.
- Late payment incurs the statutory commercial interest rate and any reasonable collection costs.
4. Cancellation and rescheduling
- By the Client — cancellation more than 14 days before the shoot date: deposit returned in full; cancellation between 14 and 7 days: deposit retained; cancellation within 7 days: 50% of the agreed fee is due.
- By the Provider — if we cannot fly due to weather, equipment failure, unsafe conditions or regulatory restrictions, we reschedule to the next suitable date at no extra cost. If rescheduling is not possible, the Client is fully refunded.
5. Shoot day
The Client is responsible for arranging access to the location, disclosing any restrictions (e.g. nearby controlled airspace, heritage sites, private property) and providing a safe take-off and landing area. Last-minute scope changes that materially extend the shoot may incur additional fees.
6. Delivery
Final files are delivered via private download link within the timeframe stated in the quote, typically 7–14 working days for video and 3–5 working days for stills. Two rounds of revisions are included; further revisions are charged at the hourly rate stated in the quote.
7. Usage rights and intellectual property
- Upon full payment, the Client receives a perpetual, worldwide, non-exclusive licence to use the delivered footage and stills for the purpose stated in the quote (typically own marketing, websites, social media and paid advertising).
- The Provider retains the underlying copyright and may use the work in its own portfolio, social channels and case studies, unless the Client has explicitly purchased an exclusive licence.
- Resale of the raw or finished material to third parties is not permitted without prior written agreement.
8. Liability
The Provider carries professional liability insurance up to €2,500,000. The Provider’s total liability under any project is limited to the amount paid by the Client for that project, except in cases of intent or gross negligence. The Provider is not liable for indirect, consequential or commercial loss.
9. Force majeure
Neither party is liable for delays or failures caused by events outside their reasonable control, including weather, government restrictions, illness or third-party network outages.
10. Governing law and disputes
These terms are governed by Dutch law. Disputes that cannot be resolved amicably are submitted to the competent court in the district where the Provider is established, unless mandatory consumer law dictates otherwise.
